Appendix No. 1: Model withdrawal form
DEFINITIONS
Working days – days from Monday to Friday, with the exception of public holidays.
Account – a free function of the Store regulated by separate regulations (service provided electronically), thanks to which the Buyer can set up their individual Account in the Store.
Consumer – a Consumer within the meaning of the provisions of the Civil Code.
Buyer – each Buyer entity in the Store.
Terms and Conditions – these Terms and Conditions.
Store – an online store GOOGLABSCI.com run by the Seller at https://www.googlabusa.com
Seller – Googlab Scientific Ltd. z o.o., entered into the Central Registration and Information on Business kept by the Minister of Development and Finance, 5862289604, No. 222038172, ul. Brzozowa 8, 83-200 Rokocin.

TECHNICAL REQUIREMENTS
For the proper functioning of the Store, the following is needed:

- Internet-enabled device
- A web browser that supports JavaScript and cookies.2.
In order to place an order in the Store, in addition to the requirements set out in para. 1. An active email account is necessary.
SHOPPING IN STORE
- The prices of goods visible in the Store are the total prices for the goods, including VAT.
- The Seller points out that the total price of the order consists of the price for the goods indicated in the Store and, if applicable, the costs of delivery of the goods.
- The product selected for purchase should be added to the shopping cart in the Store.
- Then the Buyer chooses from among the available in the Store: the method of delivery of the goods and the method of payment for the order, and also provides the data necessary to complete the placed order.
- The Order is placed when its content is confirmed and the Buyer accepts the Terms and Conditions.
- Placing an order is tantamount to concluding a sales contract between the Buyer and the Seller.
- The Seller will provide the Consumer with a confirmation of concluding the sales agreement on a durable medium at the latest at the time of delivery of the goods.
- The Buyer can register in the Store, i.e.: create an Account there or make purchases without registration by providing your data for each possible order.
PAYMENT
- You can pay for the placed order, depending on the buyer’s choice:
- By regular transfer to the Seller’s bank account.
- By credit card:
- Visa
- Visa Electron
- MasterCard
- MasterCard Electronic
- Maestro
- Via the payment platform:
- Przelewy24
- Stripe
- If the Buyer chooses to pay in advance, the order must be paid within 3 Business Days from the date of placing the order.
- The Seller informs that in the case of some payment methods, due to their specificity, it is possible to pay for an order using this method only immediately after placing the order.
ORDER PROCESSING

- The seller is obliged to deliver the goods without defects.
- The order completion date is indicated in the Store.
- In case the Buyer has chosen to pay in advance for the order, the Seller will proceed to the execution of the order after it has been paid.
- In a situation where the Buyer has purchased goods with different delivery dates within one order, the order will be completed within the time appropriate for the goods with the longest delivery date.
- The goods are delivered only on the territory of the Republic of Poland.
- Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:
- Through a courier company
- In special cases, the Seller reserves the right to exchange the ordered product for another with similar parameters and value equal to or higher than the ordered one after informing the Buyer about this fact.
- The seller reserves the right to delay the shipment of the order for a maximum of 2 working days without giving a reason due to the specifics of the products sold.
- The Seller is obliged to immediately inform the Client about possible delays longer than those specified above before the commencement of the implementation or immediately after determining such a possibility and presenting possible solutions.
- Due to the company’s structure and multi-channel sales, it is possible that some of the products included in the buyer’s order are out of stock. In this case, the Seller undertakes to inform the Buyer about this fact and determine further actions, which may be, for example, exchanging the unavailable product for another or returning the value of the unavailable products to the account indicated by the Client.
RIGHT OF WITHDRAWAL

- The Consumer has the right to withdraw from the agreement concluded with the Seller through the Store, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.
- The deadline for withdrawal from the agreement expires after 14 days from the date of:
- In which the Consumer came into possession of the goods or in which a third party other than the carrier and indicated by the Consumer came into possession of the goods.
- In which the Consumer came into possession of the last item or in which a third party, other than the carrier and indicated by the Consumer, came into possession of the last item in the case of an agreement obliging to transfer the ownership of many items that are delivered separately.
- In order for the Consumer to be able to exercise the right to withdraw from the agreement, they must inform the Seller, using the data provided in § 2 of the Terms and Conditions, about their decision to withdraw from the agreement by way of an unequivocal statement (for example, a letter sent by post or information sent by e-mail).
- The Consumer may use the model withdrawal form at the end of the Terms and Conditions, but it is not obligatory.
- In order to meet the deadline for withdrawal from the agreement, it is sufficient for the Consumer to send information on the exercise of their right to withdraw from the agreement before the deadline for withdrawal from the agreement expires.
CONSEQUENCES OF WITHDRAWAL FROM THE CONTRACT
- In the event of withdrawal from the concluded agreement, the Seller returns to the Consumer all payments received from him/her, including the costs of delivery of the goods (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest ordinary method of delivery offered by the Seller), immediately, and in any case not later than 14 days from the date on which the Seller was informed about the Consumer’s decision on exercising the right to withdraw from the agreement.
- The Seller will refund the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution, in each case the Consumer will not incur any fees in connection with this refund.
- The seller may withhold the return of payment until the receipt of the goods or until the proof of sending them back is provided, whichever occurs first.
- The seller asks you to return the goods to the following address: ul. Brzozowa 8, 83-200 Rokocin immediately, and in any case not later than 14 days from the date on which the Consumer informed the Seller about the withdrawal from the sales agreement. The deadline is met if the Consumer sends the goods back before the expiry of the 14-day period.
- The consumer bears the direct costs of returning the goods.
- The consumer is only liable for the decrease in the value of the goods resulting from using them in a manner other than it was necessary to determine the nature, characteristics and functioning of the goods.
- If the goods, due to their nature, cannot be sent back by the usual post, the Consumer will also have to bear the direct costs of returning the goods. The Consumer will be informed about the estimated amount of these costs by the Seller in the description of the goods in the Store or when placing the order.
- If there is a need to refund funds for a transaction made by the customer with a payment card, the seller will refund the funds to the bank account assigned to the Buyer’s payment card.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
- The Consumer does not have the right to withdraw from a distance agreement in relation to the agreement:
- In which the subject of the service is a non-prefabricated item, manufactured according to the Consumer’s specification or serving to meet his individual needs.
- In which the subject of the service is an item that deteriorates quickly or has a short shelf life.
- In which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygienic reasons, if the package has been opened after delivery.
- In which the subject of the performance are things which, after delivery, due to their nature, are inseparably connected with other things.
- In which the subject of the service are audio or visual recordings or computer programs delivered in a sealed package, if the package has been opened after delivery.
- For the provision of newspapers, periodicals or magazines, except for a subscription agreement.
- In which the price or remuneration depends on fluctuations in the financial market, over which the entrepreneur has no control, and which may occur before the deadline for withdrawal from the contract.
- For the delivery of digital content that is not recorded on a tangible medium, if the performance of the service began with the express consent of the Consumer before the deadline for withdrawal from the agreement and after the entrepreneur informed him about the loss of the right to withdraw from the agreement.
COMPLAINTS
- In the event of a defect in the goods, the Buyer has the right to complain about the defective goods on the basis of the warranty or guarantee regulated in the Civil Code, if the warranty has been granted.
- By using the warranty, the Buyer may, on the terms and within the deadlines specified in the Civil Code:
- Submit a statement on price reduction
- In the case of a material defect – submit a statement of withdrawal from the contract
- Demand the replacement of the item with a defect-free one
- Demand removal of the defect
- The Seller asks you to submit a complaint on the basis of the warranty to the postal or electronic address indicated in § 2 of the Terms and Conditions.
- If it turns out that in order to consider the complaint it is necessary to deliver the complained goods to the Seller, the Buyer is obliged to deliver the goods, in the case of the Consumer at the Seller’s expense, to the address ul. Brzozowa 8, 83-200 Rokocin.
- If the product has been additionally guaranteed, information about it, as well as its conditions, is available in the product description in the Store.
- Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Terms and Conditions.
- The complaint will be considered by the Seller within 14 days.
OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND PURSUING CLAIMS
If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use m.in. with:

- Mediation conducted by the Provincial Inspectorate of Trade Inspection, to which a request for mediation should be submitted. As a rule, the procedure is free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
- Assistance of the locally competent permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which a request for consideration of the case before the arbitration court should be submitted. As a rule, the procedure is free of charge. The list of courts is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq596.
- Free assistance from the municipal or district consumer ombudsman.
- The ODR online platform available at: http://ec.europa.eu/consumers/odr/.
PERSONAL DATA
- The Seller is the administrator of personal data provided by the Buyer while using the Store.
- The Buyer’s personal data is processed on the basis of the contract and for the purpose of its performance, in accordance with the principles set out in the General Data Protection Regulation (EU) of the European Parliament and of the Council (GDPR). Detailed information on the processing of data by the Seller is included in the privacy policy posted in the Store.
RESERVATIONS
- It is forbidden for the Buyer to provide illegal content.
- Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the terms and conditions. The contract is concluded on time and in order to complete the order.
- Agreements concluded on the basis of these regulations are concluded in Polish.
- None of the provisions of these Terms and Conditions excludes or in any way limits the Consumer’s rights under the law.
PROVISIONS FOR NON-CONSUMER BUYERS
- The right to withdraw from a distance agreement is not vested in an entity other than the Consumer.
- Any liability of the Seller towards the Buyer who is not a Consumer is excluded.
- In the event of a potential dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the Seller’s registered office.
- In the event of damage to the parcel in transport, delivered to the buyer who is not a Consumer, a damage report drawn up with the courier is necessary to consider the complaint. Its absence may be the basis for refusal to consider the complaint positively.

TECHNICAL REQUIREMENTS
For the proper functioning and creation of the Account, the following is needed:

- Active email account
- Internet-enabled device
- Web browser that supports JavaScript and cookies
ACCOUNT
- Creating an Account is completely voluntary and depends on the Buyer’s will.
- The Account gives the Buyer additional possibilities, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of the order or editing the Buyer’s data on their own.
- In order to create an Account, you need to fill in the appropriate form in the Store.
- At the time of creating the Account, an agreement is concluded between the Buyer and the Seller for an indefinite period of time in the scope of maintaining the Account on the terms set out in the Terms and Conditions.
- The Buyer may resign from the Account at any time without incurring any costs.
- In order to resign from the Account, the Client should send his/her resignation to the Seller at the following e-mail address: office@googlabsci.com, which will result in immediate removal of the Account and termination of the Account maintenance agreement.
- COMPLAINTS
- Complaints regarding the functioning of the Account should be sent to the e-mail address office@googlabsci.com.
- The complaint will be considered by the Seller within 14 days.
OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND PURSUING CLAIMS
If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use m.in. with:

- The Account Agreement is concluded in Polish.
- In the event of the occurrence of important reasons referred to in para. 4, The Seller has the right to change these terms and conditions of the Account.
- The important reasons referred to in para. 3 are:
- the need to adapt the Store to the provisions of law applicable to the Store’s operations
- improving the security of the service provided
- a change in the functionality of the Account requiring modification of the Account regulations.
- The Buyer will be informed about the planned change to the Account Terms and Conditions at least 7 days before the change comes into force via an e-mail sent to the address assigned to the Account.
- If the Buyer does not agree to the planned change, the Buyer should inform the Seller about it by sending an appropriate message to the Seller’s e-mail address office@googlabsci.com, which will result in the termination of the Account agreement at the time of entry into force of the planned change or earlier, if the Buyer submits such a request.
- If the Buyer does not object to the planned change until it comes into force, it is assumed that he accepts it, which does not constitute any obstacle to termination of the agreement in the future.
- In the event of a potential dispute with the Buyer who is not a Consumer, the competent court will be the court competent for the Seller’s registered office.
- None of the provisions of these Terms and Conditions excludes or in any way limits the Consumer’s rights under the law.
Newsletter Terms and Conditions
Googlabsci.com Store
DEFINITIONS
Newsletter – a service provided free of charge by electronic means, thanks to which the Service Recipient may receive from the Service Provider electronically previously ordered messages about the Store, including information about offers, promotions and new products in the Store.
Store – an online store Googlabsci.com run by the Service Provider at https://www.googlabusa.com
Service Provider – Googlab Scientific Ltd. z o.o., entered into the Central Registration and Information on Business kept by the Minister of Development and Finance, 5862289604, No. 222038172, ul. Brzozowa 8, 83-200 Rokocin.
Service Recipient – any entity using the Newsletter service.
Newsletter
- The Service Recipient may voluntarily use the Newsletter service.
- To use the Newsletter service, you need a device with the latest version of a web browser, supporting JavaScript and cookies, access to the Internet and an active e-mail account.
- E-mails sent as part of this service will be sent to the e-mail address provided by the Service Recipient at the time of subscribing to the Newsletter.
- In order to conclude an agreement and subscribe to the Newsletter service, the Service Recipient first provides their e-mail address in a designated place on the Website to which they want to receive messages sent as part of the Newsletter. Then, to the e-mail address provided in the first step, the Service Provider will send the Service Recipient a message verifying the e-mail address, which will include a link to confirm the Service Recipient’s will to subscribe to the Newsletter. After the Service Recipient confirms the will to subscribe to the Newsletter, a service provision agreement is concluded and the Service Provider will start providing it to the Service Recipient.
- Messages sent as part of the Newsletter will contain information about the possibility to unsubscribe from it, as well as a link to unsubscribe.
- The Service Recipient may unsubscribe from the Newsletter, without giving a reason and incurring any costs, at any time, using the option referred to in para. 5 or by sending a message to the Service Provider’s e-mail address: office@googlabsci.com.
- If the Service Recipient uses the link to unsubscribe from the Newsletter or sends a message with a request to unsubscribe from the Newsletter, the contract for the provision of this service will be immediately terminated.
Complaints
- Complaints regarding the Newsletter should be reported to the Service Provider at the following e-mail address: office@googlabsci.com.
- The Service Provider will respond to the complaint within 14 days of receipt of the complaint.
Personal data
- The Service Provider is the administrator of the personal data provided by the Service Recipient when using the Newsletter.
- The Service Recipient’s personal data are processed on the basis of the contract and for the purpose of its performance, in accordance with the principles set out in the General Data Protection Regulation (EU) of the European Parliament and of the Council (GDPR). Detailed information on the processing of data by the Seller is included in the privacy policy posted in the Store.
Final provisions
- The Service Provider reserves the right to amend these Terms and Conditions only for important reasons. An important reason is understood as the need to change the Terms and Conditions caused by the modernization of the Newsletter service or a change in the law affecting the provision of the service by the Service Provider.
- Information about the planned change to the Terms and Conditions will be sent to the Service Recipient’s e-mail address provided at the time of subscribing to the Newsletter at least 7 days before the changes come into effect.
- If the Service Recipient does not object to the planned changes by the time they enter into force, it is assumed that they accept them.
- If the Service Recipient does not accept the planned changes, the Service Recipient should send information about it to the Service Provider’s e-mail address: office@googlabsci.com, which will result in the termination of the service agreement as soon as the planned changes come into force.
- It is forbidden for the Service Recipient to provide illegal content.
